Personal Data Protection Law (KVKK)

GENERAL PRIVACY NOTICE

In addition to its Islamic education activities, which are our main field of work, ERENLER FOUNDATION FOR KNOWLEDGE AND SERVICE (ERENLER) carries out humanitarian aid activities in countries and regions affected by poverty, in regions affected by war and its consequences, and in disaster areas, and shows the same sensitivity in the security of personal data. With this awareness, we attach great importance to ensuring that the special and general categories of personal data of our visitors across all channels are processed, retained and deleted in accordance with the Personal Data Protection Law No. 6698, the secondary regulations (regulations, communiqués, circulars) issued and to be issued under the Law, and the binding decisions taken and to be taken by the Personal Data Protection Board. As the Erenler Foundation for Knowledge and Service (ERENLER), we have prepared this privacy notice in order to inform you about the personal data we process within the scope of our activities carried out for our purposes in accordance with the Turkish Personal Data Protection Law (KVKK) No. 6698 and the relevant legislation. Mindful of our responsibility, in our capacity as the "Data Controller" as defined in the Law, we process your personal data as explained below and within the limits mandated by the legislation.

  1. DATA CONTROLLER

ERENLER – ERENLER FOUNDATION FOR KNOWLEDGE AND SERVICE is the "Data Controller". Atikali Mahallesi, Kovacı Cami Sk. No:11, 34087 Fatih / İstanbul.

  1. PURPOSES OF PROCESSING PERSONAL DATA

ERENLER, which serves through humanitarian aid activities in disaster areas, in regions affected by war and its consequences, and in countries and regions affected by poverty, in addition to Islamic education activities, needs to process personal data both when directly fulfilling its legal obligations and in cases indirectly required by these obligations and the services provided. In this respect, your personal data are

processed by ERENLER;

  • to fulfil our obligations specified in the Social Insurance and General Health Insurance Law No. 5510 and the secondary regulations issued under this Law,
  • to fulfil our obligations specified in the Occupational Health and Safety Law No. 6331 and the secondary regulations issued under this Law,
  • to fulfil our obligations specified in the Personal Data Protection Law No. 6698 and the secondary regulations issued under this Law,
  • Foundation Cultural Assets Tender Regulation dated 09.2008
  • to provide, when necessary, the information needed by relevant public institutions and organizations, judicial or administrative courts and law enforcement authorities,

and are processed within the limits specified in the Law, in compliance with the law and the rules of good faith, and always in a manner that is connected with, limited to and proportionate to these purposes.

  1. TRANSFER OF PERSONAL DATA

Within the purposes listed above, and in accordance with the conditions specified in Articles 8 and 9 of the Law, your personal data may be transferred to natural and legal persons permitted by the legislation, when necessary to other authorized public institutions and organizations, judicial and administrative courts, law enforcement forces, institutions and organizations with which we have a business relationship, authorities and relevant ministries related to education and humanitarian aid activities, humanitarian aid associations with the same purpose with which joint activities are carried out, project partners, and consultancy, technology and education companies from which outsourced services are received.

  1. METHODS OF COLLECTING PERSONAL DATA AND LEGAL BASES

Your personal data are collected by natural or legal persons acting as data processors authorized by ERENLER, through automated and non-automated methods, verbally, in writing or electronically, by means such as e-mail, telephone, the website, various contracts, and forms and records kept on paper.

Name-surname, Turkish ID number, telephone number, e-mail, address details, entry-exit details, security records

The special and general categories of personal data specified in the table above are processed pursuant to Article 5, paragraph 2, subparagraphs (a), (c), (ç), (e) and (f) and Article 6, paragraph 3 of the Law, provided that your fundamental rights and freedoms are not harmed, and based on the legal ground of ERENLER's legitimate interests.

Apart from the data types listed above, your general and special categories of personal data such as volunteers' association and foundation membership, membership information relating to civil society organizations, and social media account information will be collected and processed with your explicit consent within the scope of Articles 5/1 and 6/2 of the Law. In this respect, the explicit consent form signed by you will be an integral part of the privacy notice.

  1. RIGHTS OF DATA SUBJECTS UNDER THE LAW

By applying to ERENLER-ERENLER FOUNDATION FOR KNOWLEDGE AND SERVICE at any time in the manner specified on our website, you may regarding your personal data;

  • learn whether they are processed, learn the purpose of processing and whether they are used in accordance with that purpose, and request information if they have been processed,
  • learn the third parties in Turkey and abroad to whom your information is disclosed in accordance with the Law,
  • request correction if you think your information has been processed incompletely or incorrectly,
  • request the deletion or destruction of your information within the framework of the conditions provided for in Article 7 of the Law,
  • request that your requests specified in subparagraphs (c) and (d) be notified to the third parties to whom your information has been transferred, and that they carry out the same operations.

If your application made for these purposes requires an additional cost, you will be required to pay the fee determined by the Communiqué on the Procedures and Principles of Application to the Data Controller issued by the Personal Data Protection Board. If a written reply is given to your application, no fee will be charged for the first 10 (ten) pages, and a processing fee of 1 TL will be charged for each page above 10 (ten) pages. If the reply to your application is given on a recording medium such as a CD or flash drive, a fee equal to the cost of the recording medium will be charged to you.

The requests in your application will be concluded as soon as possible depending on the nature of the request, and within 30 (thirty) days at the latest.

To benefit from your rights under the Law, you may submit your applications to ERENLER in writing, provided that they are in Turkish, and you may visit the website of the Personal Data Protection Authority for detailed information.

You may make your applications;

by filling in the form available at www.erenlervakfi.org and delivering a wet-signed copy in person by hand or through a notary to the address "Atikali Mahallesi, Kovacı Cami Sk. No:11, 34087 Fatih / İstanbul" İstanbul.

In the application you make to exercise the rights you hold as a personal data subject and specified above, which includes your explanations regarding the right you wish to exercise, the matter you request must be clear and understandable, the matter you request must relate to you, or, if you are acting on behalf of someone else, you will need to present your special power of attorney certified by a notary for this purpose.

Your applications must contain the name-surname, signature, Turkish ID number, residence or workplace address, e-mail address, telephone and fax number, and the subject of the request, as required by the "Communiqué on the Procedures and Principles of Application to the Data Controller". Applications that do not contain these elements will be rejected by ERENLER.

ERENLER's right to make changes to this privacy notice due to reasons arising from the Law, the secondary regulations and Board decisions is reserved at all times.
